Am I at-fault for my car accident?

This will of course depend on the circumstances of your accident. One of our experienced advisors will be happy to offer their personal opinion on your situation, but the third party’s insurer may of course view the situation differently.

The best way to assess whether you were at-fault yourself, is to look up the Highway code online and make sure you followed the rules for your particular situation – if you have, then you should be ok.

The most common scenario – hitting or being hit, in the rear of a vehicle

This is one of the more common scenarios we hear about at Car Call.

If you are hit in the rear. If your vehicle is hit in the rear by another vehicle, in the majority of cases – it will be their fault.

This is because the Highway code states that you should always adjust the way you drive according to the weather conditions and allow enough braking distance between you and the car in front to stop safely in an emergency.

If you hit another vehicle in the rear. Now the reverse applies, if you hit someone in the rear – unfortunately it will almost certainly be your fault.

Even if the car in front of you suddenly brakes hard, you should still have left enough distance between you and the car in front to stop safely – so once again, it is likely to be your fault.

There are occasionally exceptions to the above rules however and if you use our service, the solicitors we work with in conjunction with the third party’s insurer will determine the stance on liability. If you choose to use your own insurer, they will decide this for you too.

Accident assistance without a claim on your car insurance

Car Call and our partners help thousands of drivers every year make non-fault accident claims independently of their insurers. This enables them to get the assistance they need without having to pay any excess or face higher insurance costs due a claim on their policy.

Once liability has been established as non-fault, we will deliver a comparable replacement hire vehicle for you to use if your vehicle is un-roadworthy after the accident.

We then get the damage to your vehicle assessed by an independent engineer. Should the vehicle be economical to repair, We and our partners organise repairs to be carried out at one of our approved accident repair centres or at a repair centre of your own choice.

If your vehicle is a total loss, you will still be able to use your hire vehicle for up to 1 week from the receipt of your settlement cheque.

No need to claim on your insurance

Anyone who has been involved in a road accident has the right to choose who repairs their vehicle. If you were responsible for the accident you were involved in, the company that insures your vehicle would normally deal with your accident claim.

However if you were not at-fault for the accident, you can choose to either claim on your own insurance policy or make a claim independently of your insurer. To find out more call 02392 484 244 and we will be happy to help.

We and our partners help thousands of people make independent accident claims. Our service enables motorists to get the help and assistance they need to resolve their accident related issues, with the costs being recovered directly from the at-fault driver on your behalf.

No excess to pay

Unfortunately even if an accident was not your fault, your insurer will almost certainly require you to pay your excess before any repair is started on your car.

This money should of course be recovered by an insurer at a later date, but with our service - you do not have to pay it at all.

By using our independent claims service, you are not making a claim on your insurance policy and so you will have no excess to pay.

Receive a comparable replacement hire vehicle

Not all insurance policies will include a replacement hire-car for you to use if yours is damaged and unroadworthy. In fact it is typically an 'optional extra' on your policy.

Other policies may offer a 'courtesy car' but this is often just a 'basic' saloon or hatchback which may not be suitable for your needs.

Car Call and its partners will provide a comparable replacement vehicle as part of our service. This means we will endeavour to supply a hire-vehicle that similar to your own in terms of its type, make and engine size.

So whether you drive a small hatchback or a prestige sports car, we will look to provide a similar hire-vehicle that suits your needs.
