The best way to assess whether you were at-fault yourself, is to look up the Highway code online and make sure you followed the rules for your particular situation – if you have, then you should be ok.


The most common scenario – hitting or being hit, in the rear of a vehicle

This is one of the more common scenarios we hear about at Car Call.

If you are hit in the rear. If your vehicle is hit in the rear by another vehicle, in the majority of cases – it will be their fault.

This is because the Highway code states that you should always adjust the way you drive according to the weather conditions and allow enough braking distance between you and the car in front to stop safely in an emergency.

If you hit another vehicle in the rear. Now the reverse applies, if you hit someone in the rear – unfortunately it will almost certainly be your fault.

Even if the car in front of you suddenly brakes hard, you should still have left enough distance between you and the car in front to stop safely – so once again, it is likely to be your fault.

There are occasionally exceptions to the above rules however and if you use our service, the solicitors we work with in conjunction with the third party’s insurer will determine the stance on liability. If you choose to use your own insurer, they will decide this for you too.

No need to claim on your insurance
